Intellectual Properties
The intellectual property protection for the company’s drug candidates rugocrixan and fosrugocrixan is based on a combination of patent protection and data protection. Data protection represents an opportunity for market exclusivity obtained when regulatory authorities in, for example, Europe, the U.S., Canada, China, and Japan grant protection against competitors using data from Novakand’s clinical trials to register generic drugs. This data protection, which is not definitively determined until market launch, can grant a product market exclusivity of between 5 and 10 years, depending on the geographic region and whether the product is approved as an orphan drug.
The work to establish strong, comprehensive product protection is therefore a central and integral part of the priority objectives for Novakand Pharma’s research and development activities.
A review of the patent portfolio is currently underway with the aim of focusing future investments on the patent applications that provide the best protection in priority countries.
